San Diego : Mayer Resigns D.A. Position

Wayne Mayer, the veteran prosecutor convicted of petty theft by a Municipal Court jury last month, has resigned, a spokeswoman for the district attorney’s office said Friday.
Spokeswoman Linda Miller said Dist. Atty. Edwin Miller had received a letter earlier in the week notifying him of Mayer’s resignation, which was effective last Sunday.
Mayer had been on unpaid administrative leave from his $65,000-a-year job since Sept. 29, pending an outcome in his trial. On Oct. 20, a jury found Mayer, a 10-year veteran of the district attorney’s office, guilty of stealing power tools from the back of a pickup truck parked at De Anza Cove in June.
Mayer, co-prosecutor in the retrial of Sagon Penn, will be sentenced Tuesday. He faces a maximum penalty of six months in County Jail and a $1,000 fine. A spokeswoman for the California State Bar said there was no word on whether Mayer would be stripped of his license to practice law, a fate considered likely by legal experts.
Prosecutors say Mayer is the first San Diego County deputy district attorney in memory to be convicted of a crime.
