Inmates Exonerated in Food Poison Case

Four County Jail inmates, accused of adulterating food that made some inmates sick, had all charges dismissed Wednesday.
San Diego Municipal Judge Frederic A. Link refused to order the four to stand trial, citing insufficient evidence on charges of adulterating food and conspiracy to adulterate food. The four inmates were Terry Bemore, Richard Luken, Ernest Guzman and Tod Knivila.
Deputy Dist. Atty. Craig Rooten said his office has not decided whether to refile the charges. “The judge heard all the evidence. He felt this statute wasn’t designed to prohibit this type of conduct,” said Rooten.
Rooten claimed that the inmates wanted to be sent to the hospital and then sue the county because of the incident.
