Gillespie Tries to Block Judge from Hearing Case

Attorneys for Insurance Commissioner Roxani Gillespie filed an affidavit of prejudice Thursday seeking to disqualify Los Angeles Superior Court Judge Miriam A. Vogel from hearing a case pertaining to Proposition 103.
But Vogel called the move “untimely” and said she intends to go on hearing Proposition 103 cases.
The attorneys said they would seek to disqualify Vogel in all such cases in the future. They are not required to give a specific reason for seeking to disqualify the judge--and did not.
Last month, however, against Gillespie’s wishes, Vogel allowed the Farmers group of companies to go ahead with an average 5.9% statewide rate increase. A 40% increase she mandated for Allstate’s assigned-risk drivers with bad records was stayed by a higher court.
