WORLD : Reservist Sues to Avoid Gulf Duty

WASHINGTON — A National Guard reservist called up for active duty filed suit today seeking to stop his deployment to the Persian Gulf on the grounds that President Bush must first get congressional permission to wage war.
Sgt. Michael R. Ange, 26, stationed with his Army National Guard unit at Ft. Lee, Va., sought a temporary restraining order to prevent the Army from sending him to the Persian Gulf this week.
The lawsuit, filed in U.S. District Court, claims that Ange’s orders to go to Saudi Arabia are illegal because they violate the war powers clause of the Constitution and the 1973 War Powers Resolution.
