SPRING VALLEY : Death Sought in Jogger’s Killing

Prosecutors announced Wednesday that they will seek the death penalty against two men accused of conspiring to kill the wife of one of the men.
Charles Patrick Schmidt, 28, and Noel Patrick Armstrong, 22, pleaded not guilty to charges of murder and denied special-circumstance allegations that they committed the killing for financial gain and while lying in wait.
Patricia Schmidt, a 27-year-old Navy nurse, was shot in the back of the head while she jogged with her husband on Quarry Road in Spring Valley on June 15, 1989.
Schmidt allegedly paid Armstrong $400 and a flight jacket to shoot his wife with a .22-caliber handgun as he drove up on a motorcycle.
Both men are being held in lieu of $3 million bail.
Superior Court Judge Frederic L. Link scheduled a trial for Feb. 8.
