Inmate Sues for Injury After Falling From Bed

THOMASTON, Me. — An inmate has filed a $60,000 lawsuit against a Maine State Prison guard, claiming the guard startled him and caused him to injure his neck when he fell out of bed.
According to the suit filed in Knox County Superior Court, inmate Thomas Mitchell was sleeping in his cell when guard Peter Brooks walked by and moved a chair that had been placed between the cell bars and Mitchell’s bunk.
The noise startled Mitchell, “which caused him to spin out of the bed very fast because he feared he was being assaulted,” the suit said. The fall from the bed resulted in a neck injury, it said.
